Terms and Conditions of the TIMA FLOW Online Store
1. General Provisions

The Tima Flow online store, available at www.timaflow.com, is operated by TOBESAFE, with its registered office at Lotnicza 1/1, 82-500 Kwidzyn, Poland, entered into KRS, VAT ID: 5811957384, REGON: 221883712, e-mail: hello@timaflow.com, hereinafter referred to as the “Seller.”

These Terms and Conditions set out the rules for using the Store, placing orders, concluding sales contracts, delivering goods, making payments, and the rights and obligations of the Customer and the Seller.

Customers are required to read these Terms and Conditions before placing an order. Placing an order is equivalent to accepting the Terms and Conditions.
2. Definitions

Customer – a natural person with full legal capacity, as well as a legal entity or organizational unit without legal personality, who uses the Store.

Consumer – a Customer who is a natural person making a purchase in the Store for purposes not directly related to their business or professional activity.

Product – a movable item available in the Store that is the subject of a sales contract.

Sales Contract – a contract concluded at a distance between the Seller and the Customer through the Store.

Order Form – an interactive form available in the Store enabling order placement.
3. Store Use Rules

The Customer is obliged to use the Store in accordance with applicable law and good practice.

The Customer must not provide unlawful content.

Prices in the Store are gross prices (including VAT) and expressed in Polish zloty.

Information about products (including prices) constitutes an invitation to conclude a contract and not an offer within the meaning of the Civil Code.
4. Orders and Conclusion of the Contract

Orders may be placed via the Store’s website 24/7.

To place an order, the Customer selects a product, adds it to the cart, and completes the order form.

After placing an order, the Customer receives an e-mail confirming the order. Upon receipt of this confirmation, a Sales Contract is concluded.
5. Payments

The Customer may choose one of the following payment methods:

online payments (e.g., PayU, Przelewy24, Stripe, PayPal),

traditional bank transfer,

credit/debit card payment.

6. Delivery

Products are delivered to the address indicated by the Customer in the order.

Delivery costs are specified when placing the order.
-
The Seller delivers products within Poland [optionally: and other EU countries].

The delivery time is usually between 2 and 7 business days unless otherwise stated in the product description.
7. Right of Withdrawal (Returns)

A Consumer has the right to withdraw from the contract within 14 days from the date of receiving the product without giving any reason.

To exercise the right of withdrawal, the Consumer must submit a statement by e-mail to [e-mail address].

The Consumer must return the product in its original condition within 14 days from submitting the withdrawal statement.

The refund will be issued within 14 days of receiving the returned product.

The right of withdrawal does not apply to products made to the Consumer’s specifications or clearly personalized.
8. Complaints

The Seller is liable to the Customer if the sold product has a physical or legal defect (statutory warranty).

Complaints may be submitted via e-mail to: [e-mail address].

A complaint should include: name and surname, contact details, description of the defect, date of purchase, and the Customer’s request.

The Seller will respond to the complaint within 14 days and inform the Customer of the decision.
9. Personal Data

The Seller is the controller of Customers’ personal data.

Personal data is processed for purposes related to the execution of the Sales Contract, and – if consent is given – also for marketing purposes.
